South Carolina banned referral payments and deductible waivers by vehicle-glass businesses

South Carolina Code §39-5-170 took effect April 22, 2002. It made it an unfair trade practice for a person acting for or engaged in a vehicle-glass repair business to pay a third party for referring an insurance claimant, pay an insurance claimant in connection with glass repair or replacement, or waive or rebate an insurance deductible as consideration for selecting the glass business.

What to check

South Carolina glass shops should keep insurance-claim marketing and customer-incentive practices clear of prohibited referral payments, claimant payments and deductible waivers or rebates tied to shop selection.
