Do your West Virginia crash-parts estimates and owner consents meet the aftermarket-parts rules?

For a vehicle in its model year or the two succeeding years, West Virginia requires genuine crash parts sufficient to maintain specified manufacturer warranty qualities unless the owner consents in writing at the time of repair to aftermarket crash parts. Before crash-part repair begins, a body shop must give the owner a list of intended replacement crash parts, identify whether they are genuine, and identify the manufacturer of aftermarket parts. When aftermarket parts will be used, the estimate must include the statutory statement, and the required notices must be clear, conspicuous, on a separate piece of paper, and in 10-point capital type.

Quick check

Give the owner the required parts list before work, obtain written consent for aftermarket parts on vehicles in the protected three-year window, and attach the required 10-point-capital disclosure when aftermarket parts are used.
