Are any of your South Dakota repair offers improperly waiving an insurance deductible?

South Dakota law prohibits a motor vehicle repair contractor from advertising, promising, offering, paying, or rebating all or part of an applicable insurance deductible. A contract between the contractor and the customer is null and void if the contractor violates the statute.

Quick check

Remove any ad, coupon, credit, promise, or payment that covers all or part of the customer's insurance deductible.

When this applies

Your South Dakota garage, repair shop, or body shop performs insurance-paid motor vehicle repairs.

Do not advertise or offer to waive, pay, credit, or rebate a customer's insurance deductible as an inducement for motor vehicle repair work. Review marketing, estimates, coupons, and sales scripts for deductible-waiver language.
