Is your Louisiana repairman's privilege supported by the estimate and authorization record?

Louisiana RS 9:4501 gives a garage or other repair business a privilege on an automobile for repair costs, parts, and labor. If the repairman gave an estimate, authorization is required for the privilege to cover an amount above that estimate. If the vehicle leaves the business, the privilege generally lasts 120 days from the last labor or materials; if the vehicle remains at the business, the privilege continues while it remains there.

Quick check

If the final amount exceeds an estimate, confirm the customer authorized the excess. If the vehicle left unpaid, calendar the 120-day privilege period.

When this applies

Your Louisiana garage or repair business has unpaid vehicle repair, parts, or labor charges and may rely on the repairman's privilege.

Keep the estimate and added-work authorization in the repair file. If charges will exceed an estimate, obtain authorization before relying on the privilege for the excess. Track the 120-day period when an unpaid vehicle has left your possession.
